1. Terms and Conditions of Use
This document sets out the terms governing the use of the website bizart.pt (hereinafter referred to as the “Site”, the “Shop”, or “We”) by any visitor (hereinafter referred to as the “User” or “Customer”), as well as the general conditions applicable to any purchases made therein. We recommend that you read this document carefully.
By using the Site or ordering any of the products available for sale, the User unreservedly agrees to comply with the provisions of these Terms of Use. In case of doubt regarding any of the rules, you may contact us by email at geral.bizart@gmail.com.
If you do not agree with these Terms of Use, you must not use the Site.
Please note that these Terms of Use and the General Conditions of Sale may be amended without prior notice. Therefore, regular consultation of this page is recommended, as the applicable rules are those published at the time of use of the Site or at the time of purchase.
1.1. General Information
The website bizart.pt is an online store that markets handmade ceramic products, decorative pieces, and creative services.
It was created and is managed by Rita Fernandes, taxpayer no. 217313990, operating in the market under the brand Bizart.
1.2. Products
All pieces are handmade and may present variations in colour, shape, and texture. The images displayed are for illustrative purposes only.
1.3. Shipping and Delivery
We ship to Portugal and European Union. The estimated delivery time will be indicated at checkout when the order is placed.
1.4. Intellectual Property
The User acknowledges that the contents of this Site are protected by intellectual property rights under Portuguese and European Union law, and undertakes to respect such rights.
All content on the Site — including texts, images, sounds, animations, graphic elements, layout, and structure — is the intellectual property of Bizart and may not be used outside the legally permitted scope of free use without prior written authorisation.

1.5. Use of this Website
By using this Website, the User undertakes to comply with all applicable laws and to refrain from using it for unlawful purposes or in ways that may contravene the law, morality, good customs, or infringe the rights and interests of third parties.
By registering on this website, the User declares that all information provided is true and corresponds to reality.
When registering or placing an order, the User agrees to:

Provide their name, email address, delivery address and telephone number truthfully and accurately. Without this information, it will not be possible to process the order;

Use the Site solely to make legitimate enquiries or legally valid orders;

Not to place false or fraudulent orders. If there are reasonable grounds to suspect that such an order has been placed, it will be cancelled, and the competent authorities will be informed.
By placing an order through the Shop, the User confirms that they are over 18 years of age and legally capable of entering into binding contracts.
In cases of misuse of the Site, proven fraud, unlawful benefit, or non-compliance with these Terms and Conditions or applicable law, we reserve the right to suspend or cancel the User’s access to the Site.
Access to the Site may be suspended, in whole or in part, at any time, in particular for management, maintenance, repair, modification, or updating purposes. Bizart also reserves the right to close the Site, temporarily or permanently, in whole or in part, at any time and without prior notice, without giving rise to any right to compensation for the User.

Every effort will be made to ensure that the information presented is free from typographical errors. Whenever such errors occur, they will be corrected as soon as possible.
Bizart shall not be held liable for any errors in published content, malfunctions of the Site, or for any damage arising from misuse or the inability to use the Site.
The photographs displayed are for illustrative purposes only. Users are advised to check the characteristics of each product for detailed information.
Despite Bizart’s best efforts, some products may display incorrect prices. Whenever this occurs, prices will be verified before processing the orders.
If the correct price is lower than the one advertised, the difference will be refunded. If the price is higher, the customer will be informed and may choose to accept the new price or cancel the order.

GENERAL TERMS AND CONDITIONS OF SALE
These terms define the general conditions of sale between the creator of Bizart, hereinafter referred to as the “Store” or “We,” and individuals wishing to make purchases on the website bizart.pt, hereinafter referred to as the “Customer” or “User.”
These general conditions regulate all procedures necessary to place an order on the Website and apply to sales to final consumers, under Article 3(c) of Decree-Law No. 24/2014, of 14 February.
1. Exchange and Return Policy
We do not accept returns on personalized or custom-made orders.
1.1. Right of Withdrawal (14 days)
- Under applicable law, the Customer has the right to freely withdraw from the contract within 14 days of receiving the order.
- Items must be returned in perfect condition, unused, and properly packaged in their original box. Due to the fragile nature of ceramics, items must be packed with care.
Shipping costs for exchanges are the Customer’s responsibility.
1.2. Defective Products
- If a product shows a manufacturing defect, the Customer must contact us within 30 days. After validation, the item will be replaced or refunded.
This does not apply to items listed under “Exclusive Finds,” as any defects are clearly indicated in the photos and descriptions. - The Customer should note that ceramic pieces are handmade through an artisanal process that makes each item unique. Small irregularities and slight variations in color, shape, or finish are not considered defects.
1.3. Return Procedure
If you wish to return an item purchased from our online store, please follow these steps:
1. Send an email to geral.bizart@gmail.com with the following information:
- Order number
- Full name and phone number
- Reason for return (e.g., withdrawal, defect, shipping error)
- Photos of the item (if applicable)
2. Wait for our reply.
We will respond within 2 business days with instructions for returning the item, including the address to which it should be sent.
3. Prepare the shipment:
- The item must be returned in the same condition in which it was received, unused, and in its original packaging.
Include a copy of the invoice or order confirmation.
4. Shipping the return:
- For voluntary withdrawal (within 14 days), return shipping costs are borne by the Customer.
- If the product is defective or a shipping error occurred, we will cover the return costs.
5. Refund or exchange:
- After receiving and inspecting the returned item, we will issue a refund using the original payment method or proceed with the exchange, as agreed.
- After notifying us of the return, the Customer has 14 days to ship the item.
1.4. Shipping Costs
In cases of voluntary withdrawal, shipping costs are the Customer’s responsibility. In cases of defect or shipping error, we bear the return shipping costs.

2. Prices and Payment Methods
2.1. Prices
Prices are listed in euros (€).
Product prices displayed in the online store are exempt from VAT under Article 53 of the Portuguese VAT Code.
We reserve the right to change prices without prior notice.
Prices and product specifications on this website may be altered without prior notice.
Occasionally, promotional campaigns may be available in the form of percentage discounts or promotional sale prices.
These promotions always include a defined validity period, displayed on the product page, and are subject to stock availability.
To benefit from promotional discounts, the Customer must complete and pay for the order before the promotion expires.
For deferred payments, the Store guarantees the promotional price for a maximum of 48 hours from the order confirmation date.
2.2. Payment Methods
Bizart accepts several secure payment methods available at online checkout.
Currently available methods include:

All payments are securely processed through Shopify Payments or PayPal, which ensure the protection of the Customer’s personal and banking data.
Bizart does not access or store any credit card or banking information.

3. Shipping & Delivery Times
At Bizart, every piece is created with care and attention to detail. We want to ensure your order arrives safely and within the expected timeframe.
3.1 Delivery Times
Orders are shipped via CTT (Portuguese Postal Service) with the following average delivery times after dispatch:
PORTUGAL (Mainland & Islands): 2 to 3 business days
EUROPEAN UNION: 7 to 10 business days

- Shipping costs vary depending on the weight and size of the pieces.

Orders placed in the online shop cannot be delivered to PO boxes — only physical addresses.

Although we make every effort to meet the estimated delivery times, delays may occur due to stock shortages, external factors beyond our control, or issues in the delivery area.
3.3 Atelier Pickup
Pickup available at: Rua Curas, 3A, Loures
Atelier pickup is FREE and must be scheduled after completing your purchase.
NOTE: We do not have a physical storefront — our atelier operates exclusively as a production and storage space. If you choose atelier pickup, please leave your phone number at checkout so we can schedule the pickup day and time.

4. Liability
The Store is not liable for any direct or indirect damages suffered by the Customer or third parties resulting from the use of the products sold.

6. Warranty
The Customer should note that ceramic pieces are handcrafted, making each item unique. Small irregularities and variations in color, shape, and finish are not considered defects.
The warranty does not cover defects resulting from natural wear or external causes, such as:

Improper use, including exposure to abrupt temperature changes, drops, or lack of care

Failure to follow usage or maintenance instructions provided on the Website (e.g., using pieces on stoves, ovens, or microwaves when not recommended, or washing clay pieces in the dishwasher)

Irregularities inherent to handmade production
To exercise warranty rights, the Customer must notify the Store of the nonconformity within 2 months from the date the defect was detected.
Communication must be sent by email to geral.bizart@gmail.com or by letter to the Store’s registered address, including:

A description of the issue

A copy of the purchase invoice
The Customer may choose one of the following solutions: replacement, appropriate price reduction, or contract termination.
In accordance with the nature of ceramic products, repair is not considered a viable option.
If the Customer chooses replacement, we commit to providing an identical or equivalent piece within a maximum of 60 days.

7. Applicable Law & Jurisdiction
Contracts entered under these General Terms and Conditions are governed and interpreted in accordance with Portuguese law.
In the event of a dispute with a consumer, the Customer may use the European Online Dispute Resolution Platform:
